No decision in case G1/21

Laura Fè

The oral proceedings by videoconference in case G1/21 are now closed. Unfortunately, we were left without a decision, which will be published as soon as possible.
We heard plenty of considerations on the Enlarged Board composition and on the interpretation of Art. 116 EPC. I liked the questions posed by the Rapporteur, Mr van der Eijk who seemed the most concerned with safeguarding the interests of the users.
Notably the Chairman in several occasions lamented connection instability. Notably of 14 participants to this oral proceedings only 2 were women.
G1/21 is a referral pending before the Enlarged Board of Appeal of the European Patent Office relating to the legality of holding oral proceedings at the EPO by videoconference without the consent of the parties.
